Welcome to Wizard3D ("Wizard3D", "we", "us", or "our"). We are a trademark of Speedi-Biz Australia, a certified business. We operate a business that provides 3D printed products and custom 3D printing services through our website and communication channels. These Terms and Conditions (“Terms”) govern your access to and use of our services, products, website, and related interactions.

By using our Services, you (“you”, “the user”, “customer”) agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

1. Introduction and Acceptance

1.1 Acceptance of Terms

By accessing or using the website or any Wizard3D services, you confirm that you have read, understood, and agree to be bound by these Terms and any other documents incorporated by reference.

1.2 Eligibility

Our Services are available to individuals and entities capable of entering legally binding contracts under applicable law. There are no specific age restrictions; however, users under 18 must have permission from a parent or legal guardian.

1.3 Updates and Modifications

Wizard3D reserves the right to amend or replace these Terms at any time. Changes will be posted on this page with a revised “Effective Date.” Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.

2. Services Offered

2.1 Description of Services

Wizard3D specializes in:

  • 3D printing on demand using client-supplied or custom-designed files

  • Selling pre-made 3D printed items

  • Producing unique prototypes, parts, models, and accessories via additive manufacturing

2.2 Service Limitations

We reserve the right to:

  • Refuse or cancel any order for any reason, including suspected misuse, fraud, or file/design issues

  • Modify or discontinue services, features, or pricing at any time without notice

  • Limit sales to any person, geographic region, or jurisdiction at our discretion

2.3 No Guarantee of Suitability

While we strive to ensure quality, we do not guarantee that printed objects will meet specific performance, tolerance, or use-case requirements unless explicitly stated in writing.

3. Account and Communication

3.1 No Registration Required

You are not required to create an account to place an order. Orders are submitted via our website or communication channels (e.g., email).

3.2 Email Collection and Communication

We collect email addresses for:

  • Order confirmations, tracking, and production updates

  • Customer service correspondence

  • Marketing (only with explicit opt-in consent)

You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any promotional email.

4. Orders and Payment

4.1 Placing an Order

Orders may be placed by uploading or submitting 3D model files and selecting materials, sizes, or other custom options. We may request further clarification, adjustment, or approval before production.

4.2 Order Acceptance

Orders are not binding until accepted by Wizard3D. Confirmation emails acknowledge receipt but do not confirm production until all technical and payment conditions are met.

4.3 Pricing

All prices are quoted in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. Prices are subject to change without notice but will not affect confirmed orders.

4.4 Payment Terms

Payments are due in full at the time of order unless otherwise arranged in writing. We accept payments via secure third-party processors. Wizard3D is not liable for payment issues arising from third-party systems.

4.5 Invoicing

Invoices are provided upon request and include a breakdown of costs, including material fees, design charges, and applicable taxes.

5. Production and Delivery

5.1 Production Times

Estimated production times are provided at the time of ordering and may vary based on order complexity, volume, and material availability.

5.2 Shipping and Delivery

Shipping costs are calculated at checkout or upon quotation. Delivery timelines are estimates and may be subject to courier delays. Wizard3D is not responsible for delays caused by third-party carriers.

5.3 Risk of Loss

All items are shipped FOB (Free on Board) origin. Risk of loss passes to the customer upon handover to the courier or postal service.

6. Returns, Refunds, and Cancellations

6.1 General Policy

All sales are final. Due to the custom nature of our products, we do not offer refunds or returns unless the product is very defective or significantly different from the approved design.

6.2 Acceptable Grounds for Refund or Reprint

Refunds or reprints will only be considered if:

  • The item has a major defect that prevents intended use or display

  • The delivered product deviates substantially from the approved specifications (e.g., wrong material, size, or design file)

The customer must notify us within 7 days of receiving the order, including clear photographic evidence and a written description of the issue.

Wizard3D retains sole discretion in evaluating whether an item meets the criteria for refund or reprint.

6.3 Excluded Situations

No refunds, returns, or reprints will be issued for:

  • Minor surface imperfections or cosmetic issues inherent to 3D printing

  • Errors in customer-provided design files (e.g., thin walls, unsupported geometry)

  • Changes of mind, subjective dissatisfaction, or unapproved modifications after production starts

6.4 Cancellations

Orders can be cancelled within 12 hours of placement, provided that production has not begun. After this time, cancellations are not accepted unless by written agreement.

Wizard3D reserves the right to retain a processing or setup fee for any approved cancellations.

7. Intellectual Property

7.1 Our Property

All original content on our website, including logos, product photos, site design, and branding materials, is the property of Wizard3D and Speedi-Biz Australia and protected under intellectual property laws. Use or reproduction without permission is strictly prohibited.

7.2 Customer Designs

You retain ownership of your original design files submitted to Wizard3D. By submitting them, you grant us a non-exclusive, royalty-free license to use, reproduce, and modify them solely for the purpose of producing your order.

We will not use or share your custom designs for any other purpose without your written consent.

8. Prohibited Uses

8.1 General Prohibitions

You must not use our services:

  • For unlawful, fraudulent, or abusive purposes

  • To upload harmful, violent, or offensive materials

  • To infringe upon any third-party rights, including copyright or trademarks

8.2 Brand Misuse

You are strictly prohibited from:

  • Falsely presenting yourself as a representative of Wizard3D

  • Creating counterfeit products, pages, or accounts that impersonate Wizard3D

  • Using our logos, likeness, or branding without permission

Wizard3D actively enforces its intellectual property rights and may pursue legal action against any misuse or misrepresentation of its brand.

9. Liability and Disclaimers

9.1 No Warranty

All products and services are provided “as is” and “as available.” We do not warrant that our Services will be uninterrupted, error-free, or meet your expectations unless explicitly guaranteed in writing.

9.2 Limitation of Liability

To the maximum extent permitted by Australian law, Wizard3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue

  • Loss of data

  • Injury or property damage arising out of use or misuse of 3D printed items

Our total liability, if any, shall not exceed the amount paid for the specific order in question.

10. Indemnity

You agree to indemnify and hold harmless Wizard3D, its directors, employees, agents, and partners from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:

  • Your breach of these Terms

  • Your violation of any law or third-party right

  • Your misuse of our Services or products

11. Governing Law and Jurisdiction

11.1 Applicable Law

These Terms shall be governed by the laws of Victoria, Australia, without regard to conflict of law principles.

11.2 Dispute Resolution

Any dispute, controversy, or claim arising from or relating to these Terms or the use of our Services shall be submitted to our contact email which then, we will resolve. 

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, that provision shall be severed without affecting the enforceability of the remaining provisions.

13. Entire Agreement

These Terms, along with any referenced policies (e.g., our Privacy Policy), constitute the entire agreement between you and Wizard3D and supersede all prior understandings, proposals, or agreements.
